The positive duty, mandated in December 2022, holds significant implications for all businesses and organisations across Australia – regardless of industry. This change requires employers to actively focus on preventing workplace sex harassment and discrimination, rather than responding after it occurs. It means there are now new legal obligations on employers to take proactive and meaningful action and to be able to demonstrate how they are doing this in the workplace.
